Yes, it can happen that two airlines have the same code so long as the issuing authority believes there is no likelihood of them operating in the same region. This happened with TN.
Skippers aren't on the list. Can they operate a commercial flight with paying passangers without an IATO code?

As far as I know, they only need an CASA Air Operators Certificate to operate commercial services in Australia. There is no requirement for them to be an IATA or ICAO registered airline.

And the same with Jetstar when they first started. They were sharing JQ with Air Jamaica Express (which has now ceased operations). Having shared identifiers does cause confusion at times - especially with booking engines that choose the wrong airline identifier when displaying flights.
